§ 34.01 JOINT CITY-BOARD OF EDUCATION RECREATION BOARD.

(A) (1) A Joint City-Board of Education Recreation Board is created and established as authorized by KRS §§ 97.010 through 97.055 and as stated in the agreement between the municipality and Board of Education. The City Council and the Board of Education for Williamstown City Schools in order to guide and accomplish a coordinated and harmonious development of a recreational program for the city and the schools of the city which will in accordance with existing and future needs best promote public health, safety, morals, recreation, and general welfare as well as efficiency and economy in the process of development and carrying on a well-developed recreational program and that such Board will provide opportunities for comprehensive wellness, recreation, fitness, health, exercise and physical education within the school system and city as a whole.

(2) A Joint City-Board of Education Recreation Board shall be created and established as authorized by KRS §§ 97.010 through 97.055.

(B) Membership.

(1) The Joint City-Board of Education Recreation Board shall be composed of six members and each participating governmental unit shall have equal representation thereon. Three of the members of the Board shall be appointed by the Mayor of the city and three of the members shall be appointed by the chairman of the Board of Education of the Williamstown City Schools.

(2) It is agreed that the Mayor and Superintendent shall be de-facto members of the Board. One member of the Board appointed by the Superintendent shall be a school parent. One member appointed by the Mayor shall be a public citizen of the city with no children in the school system.

(3) The terms of the members of the Board shall be four years and until their successors shall take office, except the original terms shall be one, two, and three years respectively for the members appointed by the Chairman of the Board of Education.

(C) Organization. The Board shall elect from among its members a chairman and vice-chairman. In the absence of the chairman, the vice-chairman shall act and shall have all the powers and duties of the chairman. The terms of the chairman and vice-chairman shall each be for one year or until their successor qualifies. The Board shall hold at least one regular meeting in each calendar quarter. It shall adopt bylaws for the transaction of business and keep minutes and records of all its proceedings, showing its resolutions, transactions, and other activities, and the vote of each member on each question, or if absent, or failing to vote, indicating such fact, all of which shall be immediately filed in the office of the Board and shall be a public record. All of its members, except the chairman, shall be entitled to vote on any subject or matter before the Board and four members, including the chairman or acting chairman shall constitute a quorum for the transaction of any business. In case of a tie vote or a deadlock, the chairman shall have the power to vote and shall cast his vote and break such tie vote or deadlock.

(D) Powers and duties. From and after the time when the Joint City-Board of Education Recreation Board shall have been organized and selected its officers, together with the adoption of its rules and procedure then the Board shall have all the powers and duties and responsibilities set forth in KRS §§ 97.010 through 97.055.

§ 34.02 JOINT CITY-COUNTY PLANNING COMMISSION.

The City Council of the City of Williamstown, the City Council of the City of Dry Ridge, the Town Board of the City of Corinth, the Town Board of the City of Crittenden, and the Fiscal Court of Grant County, Kentucky, in order to guide and accomplish a co-ordinated and harmonious development of these municipalities and of this county, which will in accordance with existing and future needs, best promote public health, safety, morals, order, convenience, prosperity, and the general welfare, as well as efficiency and economy in the process of development, agrees that a Joint City-County Planning Commission be created and established as authorized by KRS 100.111 through 100.181.

(A) Name. The title of the planning commission shall be the Planning Commission of Grant County, Kentucky.

(B) Membership. The Planning Commission of Grant County, Kentucky, shall be composed of the following.

(1) Three members to be appointed by the Mayor of the City of Williamstown with the approval of the City Council of the City of Williamstown, not less than two of whom shall be citizen members;

(2) Three members to be appointed by the Mayor of the City of Dry Ridge with the approval of the City Council of the City of Dry Ridge, not less than two of whom shall be citizen members;

(3) One member to be appointed by the Chairman of the Board of Trustees of the City of Corinth with the approval of the Board of Trustees of the City of Corinth, said member to be a citizen member;

(4) One member to be appointed by the Chairman of the Board of Trustees of the City of Crittenden with the approval of the Board of Trustees of the City of Crittenden, said member to be a citizen member;

(5) Four members to be appointed by the Judge of Grant County, Kentucky, with the approval of the Fiscal Court of Grant County, Kentucky not less than three of whom shall be citizen members.

(6) The term of each member, who is appointed because of his official connection with his appointing body shall be for his respective official tenure, and of the citizen members shall be four years and until their successors take office; except that the original terms of the citizen member shall be one and four years respectively for those citizen members appointed by the Mayors of the City of Dry Ridge and Williamstown and two and three years respectively for the citizen members appointed by the City of Corinth and Grant County, and two years for the citizen member appointed by the City of Crittenden.

(C) Organization. The Commission shall elect, from among the citizen members, a chairman, vice chairman, secretary, and treasurer, and any other officers which it deems necessary. In the absence of the chairman the vice chairman shall act and shall have all the powers and duties of the chairman. The terms of the chairman and vice chairman shall each be for one year. The Commission shall conduct regular meetings as it deems necessary for the transaction of its business; but there shall be at least six regular meetings annually. The Commission shall adopt by-laws for the transaction of business, and shall keep minutes and records of all proceedings, including regulations, transactions, findings, determinations, and the number of votes for and against each question, and if any member is absent or disqualifies from voting indicating the fact, all of which shall immediately after adoption be filed in the office of the Commission, and shall be a public record. Both the ex-officio members and the citizen members, except the chairman, shall be entitled to vote upon any subject or matter before the Commission and six members including the chairman or acting chairman shall constitute a quorum for the transaction of any business, however, approval of any ordinance, regulation, or order shall be made only by a majority vote of the entire Commission. In case of a tie vote or a deadlock, the chairman shall have the power to vote, shall cast his vote and break such tie vote or deadlock.

(D) Powers, Duties, and Responsibility. From and after the time when the Planning Commission of Grant County, Kentucky, shall have been organized and selected its officers, together with the adoption of its rules of procedure and by-laws, then the Commission shall have all the power, duties, and responsibilities as set forth in KRS 100.111 through
100.181.

(E) Finances.

(1) The actual and necessary expenses of operation of this Commission shall be borne by the parties hereto as follows:
City of Williamstown 30%
City of Dry Ridge 20%
City of Corinth 5%
City of Crittenden 5%
Grant County 40%

(2) The fiscal year of the Planning Commission of Grant County, Kentucky, shall be from July 1 to June 30.

(3) Quarterly the Planning Commission of Grant County shall submit to the parties hereto a statement of its anticipated expenses for the ensuing quarter and the parties hereto shall immediately forward their portion thereof to the treasurer of the Planning Commission of Grant County taking credit for any sums previously deposited with the Commission or paid on its behalf.

§ 34.03 VACANT PROPERTIES REVIEW COMMISSION.

(A) Establishment. There is established a Vacant Properties Review Commission that shall be responsible for carrying out the functions and responsibilities as provided by KRS 99.705 to 99.730.

(B) Membership. The Vacant Properties Review Commission shall be composed of five residents of the city, who shall be appointed by the Mayor and approved by the City Council. No officer or employee of the city whose duties include enforcement of city housing, building, plumbing, fire or related codes shall be appointed to the Commission.

(C) Term. Each person appointed to the Vacant Properties Review Commission shall serve for a term of two years, or until his or her successor is appointed.
