§ 38.01 ESTABLISHMENT.

There is hereby established between Grant County and the cities of Crittenden, Corinth, Dry Ridge, and Williamstown, Kentucky, the Grant County Public Safety Communications Center/Emergency Service Record Center.

§ 38.02 TAX LEVIED.

(A) Grant County shall levy a tax on each telephone line terminating within Grant County whether within or without any of the above-named cities and each city waives the right to levy such tax and to collect the proceeds therefrom.

(B) Grant County will levy a tax of ninety-nine cents ($0.99) on each telephone line terminating in Grant County, of which three percent (3%) thereof shall be paid to Cincinnati Bell Telephone Company for its charges in collecting and remitting such tax; plus any and all infrastructure costs to the Cincinnati Bell Telephone Company.

(C) Other charges, if any, authorized to be made by Cincinnati Bell Telephone shall be considered non-regulated fees and shall be so entered on individual bills and will not be charged against the tax levied.

§ 38.03 USE OF FUNDS.

The parties recognize that the funds derived from the above-mentioned tax can be used only for the receipt of emergency calls and for the dispatching of emergency equipment. The city has for many years furnished, with payments from Grant County, Dry Ridge and Crittenden, an emergency dispatching center which also was utilized for the dispatching of the personnel and equipment of the city and its electrical, water, sewer, and cable TV enterprise. The parties agree that the Grant County Public Safety Communication Center will continue to dispatch the city personnel, water department equipment and personnel, sewer department equipment and personnel, electric department equipment and personnel, cable TV department equipment and personnel on a non-priority basis at the rate of $20,000 per annum in the equal monthly payments of $1,666.66 and payable on the 1st of each month. This is to be negotiated on an annual basis between the Grant County Public Safety Communications Center and the city.

§ 38.04 OPERATION.

Upon passage of this chapter pursuant to law the operation of the Grant County Public Safety Communications Center shall be the responsibility of its Board of Directors consistent with the Inter-Governmental Agreement and this chapter.

§ 38.05 PURCHASE; INSTALLATION OF EQUIPMENT.

The Grant County Public Safety Communications Center shall purchase all necessary equipment and pay for its installation at the present Grant County Dispatching Center, Williamstown City Building, 400 North Main Street, Williamstown, Kentucky, or where the center may be located or relocated consistent with the Interlocal Agreement between the parties and shall use an appropriate portion of the proceeds of such tax to defray the cost of the equipment and its installation and financing charges in connection therewith. The balance of the fund shall be utilized for the purposes of operating the Grant County Public Safety Communications Center.

§ 38.06 RENTAL OF FACILITIES.

The City of Williamstown will continue to furnish to the Grant County Public Safety Communications Center its facilities, equipment of the Grant County Dispatching Center consistent with the Inter-Governmental Agreement and utilities as follows:

(A) (1) Grant County Public Safety Communications Center shall pay to the city at the rate of $2,400.00 per annum in equal monthly payments of $200.00 due and payable on the 1st day of each month during the first year. The annual rent payable will adjust and be negotiated on an annual basis between Grant County Public Safety Communications Center and the city.

(2) The rent shall be retroactive to July 1, 1997.

(B) (1) The city shall provide the utilities of electric, water, sewage, and heat for the cost of five percent (5%) of the total utility fees/expenses for the Williamstown City Building payable by the Grant County Public Safety Communications Center to the city.

(2) The charges shall be based on the Grant County Public Safety Communication Center's 435 square foot usage from a total of 8,326 square feet for the Williamstown City Building and shall be payable in monthly payments by the Grant County Public Safety Communications Center from the total monthly utility fees incurred by the city as hereinbefore stated.

(3) The charges/expenses and reimbursements shall be retroactive to July 1, 1997.

§ 38.07 EMPLOYEE BENEFITS CONTINUED.

(A) The employees of the Grant County Public Safety Communications Center shall continue to participate in the health, disability, and liability insurance and social security withholdings, insurance withholdings, retirement benefits and other benefits of the city, if necessary. The Grant County Public Safety Communications Center shall reimburse the city for all costs and expenses in providing the benefits to the employees of the Grant County Public Safety Communications Center.

(B) The charges, expenses, and reimbursements shall be retroactive to July 1, 1997.

(C) All parties to this Joint Ordinance and Interlocal Agreement recognize and acknowledge that the employees of the Grant County Public Safety Communications Center are under the supervision, control, and direction of the Board of Directors of the Grant County Public Safety Communication Center.
